Outline of Presentation:
In establishing and maintaining a complete insurance program, every engineering firm should include Commercial General Liability (CGL) and Professional Liability (PL) Insurance. This is not just a matter of sound and prudent risk management practice, but the maintenance of both types of insurance is all but mandatory in the existing marketplace for professional services. Every client or potential client of any engineering firm has its own standard set of “insurance requirements” that it imposes on all contractors, consultants and vendors with whom it does business, so maintaining both CGL and PL insurance becomes a necessity and yet one more element of the cost of doing business.
CGL and PL insurance policies are not the same. They cover separate risks. Understanding what each policy covers is important since these two forms of liability insurance are not interchangeable. This presentation compares and contrasts these two forms of insurance with the focus on explaining what risks and losses they cover and what they do not. The discussion included here is not intended to be an exhaustive review of all detailed aspects of insurance law and practice, but is rather intended to be a practical guide to the fundamentals of these types of insurance and what a careful and prudent engineer or engineering firm should know in dealing with insurance issues.

BIOGRAPHICAL INFORMATION - MICHAEL T. LYNCH:
Michael T. Lynch is a Principal of and serves as Corporate Counsel for Harley Ellis Devereaux, a national architectural and engineering firm, with offices located in Southfield, Chicago, Los Angeles, San Diego and San Francisco, California. The firm provides professional services in multiple industry sectors. He is a member of the State Bar of Michigan. He is experienced in both litigation and transactional matters involving construction law and professional liability issues. He has served as both a mediator and arbitrator in numerous construction disputes and has lectured extensively on construction law related topics. He is a co-author of several books regarding construction litigation and the legal liability of design professionals. He is on the roster of neutral arbitrators of the American Arbitration Association for construction industry disputes. He was in trial practice with Plunkett Cooney, P.C. of Detroit for 25 years before joining Harley Ellis Devereaux in 2001. He is a graduate of the University of Detroit School of Law and has been in practice since 1974.
